dishlist terms of service

Agreement. These terms are a contract between you and Dishlist, Inc. By using the dishlist app or website, or by signing in, you agree to them. If you don't agree, don't use dishlist. You must be at least 13 years old to use it. Apple's standard Licensed Application End User License Agreement also applies to your download of the app from the App Store.
Your account. You are responsible for what happens under your account. Sign in with Apple is the only way in, so keep your Apple ID secure.
The catalog is ours. The dishlist catalog is our work: the dish and drink records, the tags and the taxonomy behind them, the selection of places, the descriptions, the photographs, and the way it is all arranged. It is protected by copyright and other laws. Menus themselves belong to the restaurants that wrote them. Place data includes content from Foursquare Open Source Places and Overture Maps under their own licenses, listed under Acknowledgments in the app. The dishlist name and logo are our marks.
Your license. We grant you a personal, non-commercial, revocable license to use the catalog inside the dishlist app and website. That is the only license you get.
What you may not do. You may not:
- scrape, crawl, or bulk-download the catalog, from the app, our servers, or anywhere else;
- copy the catalog out of the app or its files;
- access our servers with anything other than the dishlist app;
- redistribute, publish, sell, or license the catalog or any substantial part of it;
- use the catalog to build or train another product, dataset, or model;
- attempt to get into our servers, or at other users' data, in any way we haven't opened to you;
- create accounts by automation;
- reverse-engineer the app or work around any limit we place on access.
Your content. What you save, rank, and tag, your handle, and the reports you send are yours. You give us the license we need to store them, show them to you, and show them to the followers you approve. We don't use them for anything else. Suggestions you send us about dishlist are ours to use without obligation to you.
Handles and follows. Don't use a handle that impersonates someone or that is abusive. We may remove a handle or close an account that breaks these terms.
Accuracy. Menus, prices, hours, and availability change, and we may be behind. Dietary and ingredient information is informational, may be wrong, and is no substitute for asking the restaurant, especially about allergies.
Termination. You can stop using dishlist any time, and delete your account from Settings inside the app. We can end your access if you break these terms, and we can change or discontinue dishlist at any time. The sections on the catalog, your content, warranty and liability, indemnity, and governing law survive the end of your account.
No warranty; limited liability. dishlist is provided as is, without warranty of any kind. To the extent the law allows, Dishlist, Inc. is not liable for indirect, incidental, or consequential damages arising from your use of dishlist, and our total liability to you is limited to the amount you paid to use dishlist. Where the law does not allow these limits, they apply as far as it does.
Indemnity. If a third party brings a claim against us because of your content or your breach of these terms, you will cover our costs, including reasonable attorneys' fees.
Changes. When these terms change we post the new version here with a new effective date. Using dishlist after that means you accept the change.
Governing law. These terms are governed by the laws of the State of California and the United States. Any dispute goes to the state or federal courts in San Francisco, California, and you agree to their jurisdiction. California residents may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or (800) 952-5210.
General. If a court finds part of these terms unenforceable, the rest still applies. You may not assign these terms; we may. These terms are the whole agreement between you and us about dishlist.
